Are Fireworks Legal to Buy and Use in Burke?

Fourth of July is next week and many people, including Burke residents, will want to celebrate the July 4th holiday with fireworks.

Here in Fairfax County, there are rules on which types of fireworks are allowed and where you can buy them.

But are fireworks legal in Fairfax County? Short answer: yes, to an extent.

Only certain fireworks can be purchased and used in Fairfax County, Sparklers and fireworks such as super novas, cuckoos, pyro rain and hundreds other types of fireworks are allowed in Fairfax County under the Code Compliance guidelines from the Office of the Fairfax County Fire Marshal.

Anyone found in possession of illegal fireworks can face jail time and penalties up to as much as $2,500, so Burke residents should keep that list of fireworks in mind when purchasing fireworks for next weekend.

The code further states that permissible fireworks should only be used on private property with the property owner’s approval. Permissible fireworks also cannot be used or ignited inside, under or within 50 feet from any structure.

Only individuals who are over 18 may purchase fireworks. Anyone under the age of 18 has to be accompanied by a parent or legal guardian to buy fireworks.
